3.3 Purchase procedure

The shopping cart will contain the reference of the selected item, its name, size, chosen color and price, in the corresponding currency (taxes included). The expressed price does not include transportation, whose rates will vary depending on the shipping method selected.
Before placing the order, a summary of the order will be presented to the customer, identifying the product(s) added to the shopping bag, its total price (transport and taxes included) with each of the items broken down and the order shipping data. , so that the client confirms it by clicking on the button with the expression 'Confirm payment'.

Once the order has been placed, the order number will be communicated through the Website itself so that the customer can, at any time and from their device, track it. Receipt of the aforementioned order acknowledgment does not mean acceptance of the order by Tartaruga. The customer's order constitutes an offer to Tartaruga to purchase the product(s). All orders are subject to acceptance by Tartaruga.
Tartaruga is not obliged to accept the order and may, at its discretion, deny acceptance. The customer, however, acknowledges that by clicking on the “Confirm payment” button, he or she acquires the obligation to pay for the product(s) when Tartaruga accepts the order. In this sense, when Tartaruga accepts the order, it will notify the customer through a new email confirming that the order has been sent or, where applicable, that it is available for collection (the “Confirmation”). Without prejudice to what is contained in point 3.5. Following, the contract between the client and Tartaruga in relation to the product(s) ordered will be deemed perfected when Tartaruga sends the client its Confirmation. The Contract will only deal with the product(s) that have been accredited in the Confirmation.
Tartaruga will not be obliged to supply any product(s) that has not been confirmed.
3.4. Product Availability
All orders are subject to product availability. If at the time of issuing the order, Tartaruga detects a lack of stock in its warehouses of any of the products included in it, Tartaruga will try to locate the product by other means that may be within its reach. If it is not possible to have such availability, the client will be notified immediately. In addition, the amount of the item charged and not sent will be paid to the customer in the following days, by the same payment method used in the purchase.
3.5. Right to not accept an order
Tartaruga may cancel any Confirmed order or not accept an order placed for the following reasons:
In the event of a technical error and/or a typographical error in the prices or in the rest of the product data contained on the Website when the order was placed.
Due to lack of availability as described in point 3.4. former.
When security systems indicate that the order may be fraudulent.
When there are reasons that indicate that the client is a minor.
When Tartaruga has not been able to deliver the order to the address provided by the customer.
When there is a computer attack, virus or any event that is beyond the reasonable control (force majeure) of Tartaruga.
In such cases, Tartaruga will fully refund the amounts that have been paid in accordance with the provisions of section VI below.
4. PRICE AND PAYMENT
4.1 Payment and currency
Prices on this Website are shown in Euros. The customer can buy from the country they prefer. If during the purchase procedure the customer changes the delivery address and the destination country is modified, the prices and availability of items shown in the final order summary will be updated. Product prices may change at any time but the Possible changes will not affect orders in which Tartaruga has sent its confirmation to the customer.
4.2 Value added tax
All prices of the products that appear on this Website include VAT at the rate in force at all times. For deliveries made in the Canary Islands, Ceuta and Melilla, the corresponding taxes and excise duties will be applicable in accordance with the regulations in force in each of these territories.
The client gives his express consent to issue the invoice in electronic format. If the customer wishes to receive an invoice in paper format, they can request it at any time by contacting our Customer Service.
4.4. Payment Methods
Tartaruga will only accept payments made through credit or debit card, PayPal, by bank transfer for telephone purchases or cash on delivery.
Payment by credit or debit card
Tartaruga accepts payment for purchases made through the Website with the following credit or debit cards: Visa, Visa Electron and MasterCard.
If the payment method chosen by the client is a credit or debit card, the charge will be made online, that is, in real time, through the payment gateway of the corresponding financial institution, once it has been verified. that the data communicated are correct.

Tartaruga agrees to process the payment through the Paypal system.
Paypal express payment
Customers can link their Paypal account with that of Tartaruga. In this way, it will not be necessary to enter personal data in each purchase made through this system.
Payment by bank transfer
Payments by bank transfer will only be possible for telephone purchases through Customer Service.
All expenses derived from making payment by transfer will be borne by the client. For payments to be made by transfer, clients will be provided with the account number to which they must make the deposit. For reference, the customer must indicate his order number and full name.
The customer will have a period of three (3) business days from the date they placed their order to make payment. The order will not be considered accepted until it is confirmed that the payment has been received.
If after the indicated period Tartaruga has not received the corresponding amount, the order will be canceled.
4.5. Payment security
With the aim of providing maximum security to the payment system, Tartaruga uses secure payment systems from leading financial institutions in electronic commerce. In this sense, confidential payment data is transmitted directly and in encrypted form (SSL) to the corresponding financial institution. For payment with Visa and MasterCard cards, Tartaruga only accepts CES (Secure Electronic Commerce) transactions including, if applicable, the international 3D Secure protocol distinguished by the Verified by Visa and MasterCard SecureCode badges.
Secure Electronic Commerce is an initiative whose basic principle is to guarantee security in Internet transactions. When making the payment through the secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. Next, you will connect with the issuing bank, which will request that you authorize the operation using a personal authentication code. The operation will only be carried out if the bank issuing the credit card confirms the authentication code. Otherwise, the transaction will be rejected.

As a complementary measure to the 'Secure Payment' system and with the aim of collaborating in the prevention of fraud through the Internet, Tartaruga reserves the right to verify the personal data provided by the client as well as adopt the measures it deems appropriate (including cancellation of the order) so that the purchased merchandise is delivered in accordance with the data contained in the order.
4.6. Purchase limit
Purchases cannot be made for an amount greater than 2,500 euros or that contain more than 40 products. Customers who are interested in making purchases greater than said amount or amount for other purposes such as resale should contact Customer Service where they will be informed about the different options to make the desired purchase.
The risk of the products will be borne by the customer from the moment of delivery. The shipment of the products purchased through the Website will be carried out through a courier company and will be delivered within a period indicated on the Website according to the shipping method selected and, in any case, within a maximum period of thirty (30) calendar days from the date of receipt of the Confirmation.
Home deliveries will have no cost for orders over 60 euros, in the case of orders less than that amount the shipping cost will be 3.95 euros. You can also request urgent home delivery at a cost of 4.95 euros. The Urgent service will not be available during sales periods or special promotions.
To avoid incidents in delivery (wrong addresses, inability to find someone at home, etc.), it is essential to correctly complete the corresponding form.
Order tracking can be done through the Website where it will be indicated, at all times, where the product(s) are located until final receipt. The transportation price is calculated based on the shipping method chosen and the total price of the products purchased.
The exact transport price will be calculated by including each item in the shopping bag and will appear broken down on the page summarizing the purchase before the customer confirms the order by clicking on the 'Confirm payment' button and before entering of payment details.
Shipping of orders to military bases or post office boxes will not be possible. Shipping costs may be modified at any time without prior notice. 6. ONLINE EXCHANGES AND/OR RETURNS POLICY
6.1. Right to withdraw from the purchase and/or change the size
The Customer has the right to withdraw from the purchase and return the purchased product(s) and/or change its size (except for the products described in clause 6.2. below), without the need for justification, within a period of 15 calendar days. counting from the date of receipt. 6.2 Conditions for exchanges and/or returns
Tartaruga will not be able to accept exchanges or returns of used or damaged garments (as long as it is not a defect and/or defect in quality or manufacturing). For hygiene reasons, sealed products, such as underwear and bathroom items that do not retain the label or protective device, cannot be returned. Customized clothing and accessories cannot be exchanged or returned.
The exchange of a model for a different one will not be accepted, so only the size can be changed. To exchange a product for a different one, the customer must return it and make a new purchase.
Any return or exchange of purchased products must be carefully packaged and include the delivery note or the duly completed return or exchange form. If you do not have these documents at the time of making the exchange or return, you can download the return or exchange form by accessing the order detail page in the “My purchases” section available on the Website.
6.3. Exchanges and/or returns in store
The products purchased through the Website are part of the Tartaruga product collection. In the case of returns, a cash receipt will be provided in store as proof of said return and payment of the amount will be requested. The return information will be sent to our Teo headquarters (A Coruña, Spain), from where the refund will be made using the same payment method used in the purchase.
6.4. Exchanges and/or returns with home collection service
The change of size or the return of products purchased on the Website may be made through the free home collection service that Tartaruga makes available to its customers. Customers who wish to make a size change or return through the home collection service must make their request online through the Returns section in the My Account section.
If you do not have an account, you must access the My Purchases section.
Once the request has been confirmed, the carrier will contact the customer to specify the day and time of collection.
This service is not available in Ceuta, Melilla, the Canary Islands or abroad. In this case, the shipping costs of the products will be borne by the customer.
It will not be possible to request the home collection service.
Once the product(s) have been received, Tartaruga will verify their good condition and, if an exchange has been requested, it will proceed to send the required size or, if a return has been requested, it will proceed to refund the amount in the same payment method used. in the purchase. Once the status of the returned products has been verified, the customer will be informed via email. The refund will be made within a period of fourteen (14) calendar days from that Tartaruga has been aware of the decision to withdraw. However, Tartaruga may withhold the refund until it has received the goods or until the customer has presented proof of their return, depending on which condition is met first.
Reimbursement of shipping costs will be made after the products are received. To pay for orders paid by bank transfer, the customer must indicate an IBAN code to Tartaruga so that the corresponding amount can be paid. The IBAN code must belong to a bank in the country to which the order is sent.
In any case, the client will not incur any financial costs as a result of the refund.
6.6. Return of erroneous or defective products
In the event that Tartaruga has mistakenly sent a product different from the one requested, that the quality of the product sent is not adequate or that the product does not comply with what is stipulated in the contract, Tartaruga, once the error or defect has been verified , will fully refund the amount of the returned product and the shipping costs incurred as well as any other costs that the customer would have incurred to return the defective product.
In the event that an erroneous or defective order is returned by ordinary mail, Tartaruga will make the corresponding payment for return transportation as long as the customer includes in the package proof of the expenses incurred for such return.
To clients who make their purchases as consumers, Tartaruga offers guarantees on the products marketed through the Website, for any lack of conformity that appears within a period of two (2) years from the delivery of the product. .
Unless proven otherwise, it will be presumed that any lack of conformity that appears in the six (6) months following the delivery of the product already existed when the product was delivered.
In this sense, if any of the products do not comply with the contract, the client must inform Tartaruga through any of the means of communication provided for in point XII below.
8. TRANSFER AND WAIVER OF RIGHTS
The client may not transmit, assign or transfer a contract or any of the rights or obligations derived from it without having previously obtained the written consent of Tartaruga.
No waiver by Tartaruga of a right to specific action derived from this contract will imply a waiver of other rights or actions unless expressly communicated in writing.
9. RIGHT TO MODIFY THESE TERMS
TARTARUGA may modify these conditions at any time without allowing, in any case, their retroactive application.
